News of the Week
đ¤Â Kik Launches DefendCrypto
Canada-based messaging app firm Kik has launched a crypto crowdfunding campaign to support a likely court battle with the U.S. Securities and Exchange Commission (SEC) over its 2017 initial coin offering (ICO).
Announced by Kik founder and CEO Ted Livingston and Patrick Gibbs, a partner at law firm Cooley LLP, on the UnChained Podcast Tuesday, the campaign is being launched in the hopes that âa lawsuit would eventually result in a new Howey test for crypto tokens, to determine which ones are a security.â
A dedicated website â dubbed Defend Crypto â has already been set up allowing supporters to contribute to the fundraising effort, that its founders say is not only in support of Kik but many crypto firms that face potential action from the U.S. regulator. The site offers donation options in 19 cryptocurrencies, including bitcoin (BTC), ether (ETH) and XRP, as well as less standard options like augur (REP), DAI and, of course, Kikâs kin (KIN) token.
âď¸Â Australian Securities Watchdog Updates Guidance on ICOs and Crypto Assets
The Australian Securities and Investments Commission (ASIC) has issued updated regulatory guidance for businesses involved with ICOs and crypto assets.
Announced Thursday, the guidance details the legal obligations for cryptocurrency firms under the countryâs Corporations Act, the ASIC Act and other laws.
ICOs and crypto assets in many cases are financial products or involve financial products that are regulated under the Corporations Act, according to ASIC. Therefore, if a firm is issuing a token that falls within the definition of a financial product (such as an interest in a managed investment scheme or a security), laws will apply, including the requirement to hold an Australian financial services (AFS) license.
Laws also cover those giving advice, dealing, or providing other intermediary services for crypto-based financial products.
đşď¸Â World Economic Forum Launches Global Councils
World Economic Forum has announced the creation of six global councils whose aim is to help with new technology governance. The six Global Fourth Industrial Revolution Councils will cover artificial intelligence, autonomous mobility, blockchain, drones, internet of things and precision medicine.
The councils will help with developing policies to govern new technologies as well as address âgovernance gapsâ or total absence of regulations. They will provide a platform for exchanging policy and regulatory experience cross-country. They will also work on what best policy practices should involve. The councils will also co-operate with the Centre for the Fourth Industrial Revolution Network, providing it with âstrategic guidanceâ when it comes to the governance projects and planned pilots.
